BY U.S. RESIDENT TO SPOUSE
The immigration laws of the United States permit the immigration
of the "immediate relatives" of
U.S. citizens who wish to become immigrants. They are divided into categories based on a
preference system.
There are four categories with different waiting times for
each category. The family-based preference
categories are as follows:
1st. Preference: Unmarried sons and daughters
of U.S. citizens.
2nd Preference: Spouses and unmarried
sons and daughters of lawful permanent residents,
3rd Preference: Married sons and daughters of
U.S. citizens
4th Preference: Brothers/sisters of U.S.
citizens.
If you are a spouse of a U.S. resident – you
belong to the 2ndh Preference - , your U.S. resident
spouse can file a petition for you. However, this petition
does not allow you to obtain your residency
immediately nor give you the right to work legally in the U.S.
If you want to obtain your residency, you will have to wait for
the visa to become available.
If you want to know how long you have to wait. The Department of
State publishes these processing times, known
as priority dates every month.
